General terms and conditions

for CV Motorsport GmbH trackday events
1. Scope

These general terms and conditions (GTC) apply to participation in trackday events held by CV Motorsport GmbH, Brombeerweg 2, 57392 Schmallenberg, managing director Jan Lehmann. Only German law applies. The place of jurisdiction is Koblenz.

2. Conclusion of contract & payment terms

Bookings are made exclusively via the CV Motorsport GmbH website. By submitting the booking, the participant makes a binding offer to conclude the contract. The contract is concluded as soon as the participant receives a booking confirmation by email. The participation fee is due immediately upon booking. Payment is made via the payment service provider Stripe. The amount of the participation fee is stated in the event description and at checkout.

3. Participation requirements
  • Minimum age: 18 years
  • Valid class B driver's license required
  • Vehicles with and without road approval are allowed
  • Maximum allowable volume: 100 dB (A) — mandatory

The participant acknowledges that this is a motorsport-like event that is driven at their own risk. Each participant is responsible for any damage caused by them. The organizer's liability for property or personal damage is excluded, to the extent permitted by law. Each participant is required to sign a written disclaimer on site. Without this signature, participation in the event is not possible. In this case, there is no right to a refund of the participation fee.

4. Procedure & behavior on the track

The rules of conduct will be introduced on site during the driver briefing. The instructions of the organizer and the track guards must be followed in full. If safety or conduct rules are violated, the participant may be excluded from the event. In this case, the participation fee will not be refunded.

5. Additional services

Optionally bookable services such as driver coaching, fuel service, video evaluation or taxi rides are not part of the basic contract and can be booked additionally. Availability cannot be guaranteed.

6. Photos and videos

During the event, photo and video recordings will be made by the organizer or commissioned third parties. By booking, the participant agrees that these recordings may be used free of charge for documentation and advertising purposes (online and offline). This applies in particular to social media platforms, the organizer's website and promotional materials.

7. Withdrawal by the participant

According to Section 312g (2) No. 9 BGB, there is no right of withdrawal for our trackday events, as these are leisure services with a fixed date.

8. Cancellation by the organizer

The event will be held subject to a sufficient number of participants. If this is not achieved, the organizer can cancel the event up to 5 days before the date. In this case, the participant will be offered either a free rebooking to another date or a full refund of the participation fee. In addition, the organizer reserves the right to cancel the event at short notice for reasons of force majeure, official orders, weather conditions or technical safety reasons. In these cases, a rebooking or refund will also be made.

9. Liability

Participation is at your own risk. The organizer is only liable for intent and gross negligence. Liability for damage to vehicles, subsequent damage or other indirect damage is excluded, unless liability is mandatory by law.

10. Final provisions

Should individual provisions of these terms and conditions be or become invalid in whole or in part, the effectiveness of the remaining provisions remains unaffected.
